fearless1 (11/28/2007) He has done nothing wrong!and maybe he is looking for a per mile estimate so he can take care of the shipping when he sell,s the car!How do you know this? He never asked for an estimate for any thing. "Maybe" (most likely) he is just taking up space & trying to sell this car. What good are Rules if no one from U-Ship P.R. reply's to this stuff. Tommy

Sort of like contracting an illegal service provider that is not authorized to transport across state lines to transport your motorcycle across state lines, right tommy? What good are federal laws if you aren't going to abide by them.

| contracting an illegal service provider .... Not true, he is a sevice provider, Moving a 240 Lbs 150cc Scooter in the back of a Reg pick-up is not a true DMV or DOT matter.

| Sorry but you are wrong. Transporting anything across state lines for compensation requires MC numbers. The under 10,000 lb rule applies to intrastate only. Once you go across any state line the feds require the MC authorization and insurance. Check out http://www.fmcsa.dot.gov/registration-licensing/online-registration/onlineregdescription.htm for more info. Thanks. Chuck

| That information is not necessarily correct. If your company only operates vehicles under 10,000 GVWR and licensed weight, these vehicles are not defined as CMVs. Assuming you do not transport a specified number of passengers or HazMat, and in some situations "exempt commodities", you may not require a DOT & MC number even if you're transporting for compensation interstate. BUT....some states may require a DOT number anyway. Your best bet is to go to http://www.fmcsa.dot.gov/registration-licensing/online-registration/onlineregdescription.htm and run through the little exercise "Help Me Register" under registration assistance. Read the definitions carefully..........This is a long running debate in the forum so if there is a question the best bet is to understand Part 390 throughly and especially the definitions. Commercial motor vehicle means any self-propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property when the vehicle: - Has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 4,536 kg (10,001 pounds) or more, whichever is greater; or
- Is designed or used to transport more than 8 passengers (including the driver) for compensation; or
- Is designed or used to transport more than 15 passengers, including the driver, and is not used to transport passengers for compensation; or
- Is used in transporting material found by the Secretary of Transportation to be hazardous under 49 U.S.C. 5103 and transported in a quantity requiring placarding under regulations prescribed by the Secretary under 49 CFR, subtitle B, chapter I, subchapter C.

I just did it using a vehicle under 10,001 lbs and transporting interstate. The result:| Operating Authority (MC Number) OP-1 |
| The system has determined that you need to file an OP-1 application for an operating authority (MC number)

You must be answering one of the questions wrong because it should not give you that result unless you're hauling passengers or HazMat. The determination is made on if the company operates CMVs as defined or over 10,001 lbs. This one has been beat all to hell here and interpreted differently by many. I have emails from a couple of DOT officers that interpret it the same way I do. Not that it means a lot but I'll be more than happy to send them to you if you email me.
