So far, I'm violating the HOS regulations....Did you notice anything other discrepancies in the scenario given?Don Your stopped for the 10 hr break and they could fine you for log book not being up to day change midnight date entries. Any stops befor midnight should have been entered during that 12 hr running time. If the go crazy they can be put you out of service till the light are fixed and another fine. If you are telling them you knew the light were out when you started the trip, that should have been fixed during the pretrip you filled out if you did. bumpus

| Hmmmm might it be your not in compliant with your logs and put out service for both offenses, Logs and lights, maybe lights might just get a warning or fix it. But logs------ 10hrs of sleep comming due.

| Did I just read, that we can run the Illegals out of Business on UShip, by underbidding them. My thoughts are that if we continue to pay all the regulatory Fees and Insurance etc., and underbid the Illegals, only the Illegals will survive because they do not pay anything but UShip!!!!!.

Hey Don,
I would consider you Desperately Compliant. You got all your fed stuff taken care of. You spent just enough time at the Flyin'J gettin fuel and eatin the buffet to make up the Time /Mileage difference in your log. You knew those lights were out at your first fuel stop when you did your walk-around. If not then 40-11 truckers have already called you on the radio to let you know they were out. if not that, somebody has blinked their lights at you to let you know. You now are left with weighing the difference between a ticket for your logs and the difference in late delivery penalty. You opt for the ticket. Now if you were headed west toward Limon, that dude in the coop that looks like Fred Flintstone would definetely write you up. But you got the guy that bangs on the computer like he was hammerin nails. Now, that guy will give you a hard time just to watch you sweat but, he would let you work on the lights later. So, Roll on Buddy and don't let your lettuce wilt

Scenario..... I have active US DOT and MC# with authority to transport general freight interstate. All my filings with FMCSA are current including MCS-9X (required insurance), process servers, etc. My load is well under the tagged limit for the truck & trailer and the recommended GVWR/CGVWR. I'm hauling a perishable load, lettuce that pays a bonus for early delivery and has a penalty for late delivery. The load is secured properly and meets the requirements of the Driver's Handbook for Load Securement. I'm traveling across I-64 in KY at the speed limit at 4:00 am in the dark. Unknown to me, I have two burned out running lights on the rear that have failed since I started driving at noon yesterday. I pull through the open coop and the inoperative lights are spotted so I'm told to pull to the side and come in with my paperwork. It is a little stressful, because my log book entries are behind for the last several meal & fuel stops. You are a compliant carrier because you have everything required to run interstate. However, in this scenario, you are running non-compliant. 1) You are hauling outside of your cargo classification. Fresh produce does not fall under General Freight. 2) Is your trailer a refer? If not, the lettuce probably wouldn't survive the trip anyway. 3) You are operating outside the 11/14 without 10 consecutive hours off duty. 4) Log book not up-to-date. Must be current to within last stop. 5) How did they see the rear of the trailer to notice the inoperable lights? What will they do? I think you would get a severe slap on the wrist (maybe with a ruler) for hauling out of cargo classification. They would probably tell you to update you MCS-150. I still think the classifications are pretty much just a way of telling the government what you are likely to haul. You will probably be fined for log book violations. You will be shut down for a minimum of 10 hours. Maybe 34 after checking your last week's logs. Unless they want to do a full-blown inspection, they would probably just tell you to get those running lights fixed as soon as possible. A real horses' butt would fine you and might say get them replaced before leaving the coop. Of course that would be after your 10 hours off duty. No really sure about hauling produce without being refrigerated. They would probably wake you up and tell you get that stinking stuff out of their station. And your trip just got more expensive. You got penalized for late delivery, paid for the cargo out-of-pocket because your insurance company wouldn't cover it. Non-compliant, but not illegal. Don, did I get close? Rick RUN SAFE. RUN LEGAL.

My 2 Cents You can be compliant but have an infraction, thus making you non-compliant, which makes you illegal. All of the rules, and regulations are the Governments way of saying, we have you by the NADS, we just need to decide how hard were going to squeeze!!! OLD COWBOY LOGIC Clyde10horse
