| I have done some research here in virgina,it was not easy. Every one at first was just telling me to call this one or that one, you know the drill. Well after some comunication gaps were closed I now realise some potenial pros and cons with my orginal plans. So before I attempt to do to much more, with this industry, (hotshotting)how realistic to get paid on delivery. Do I have the right to NOT un load un'till paid? Also would any of you profesnials, please advice me on how to right and stick to a good starters business plan? | get paid before unload once it touches the ground or unhooked your finished an make sure you have a signed contract,an make sure you have a digital camera.jack Indian

GENERAL INFORMATION REGARDING HOSTAGE LOAD SITUATIONS ON SHIPMENTS MOVING IN INTERSTATE COMMERCE A carrier has a lien on the property it is transporting for freight charges and any other charges lawfully incurred on that shipment. The lien is specific to that shipment, however, and does not extend to other shipments which have moved under other bills of lading. Thus, a carrier may withhold delivery of a shipment until all charges relative to that particular shipment are paid. The carrier may not, however, withhold delivery of one shipment to enforce the collection of past due freight charges on another shipment.

Of coarse what has been said above only applies to carriers with up to date DOT and MC numbers

Someone transporting without proper authority could find themselves not getting paid at delivery. That could be based on the issue that operating without legal authority, you're not legally able to enter in to a contract to transport interstate for hire. Therefore if you don't have an enforceable contract, they wouldn't necessarily have a legal obligation to pay you. Maybe they'll just call the local boys in blue and say you have no right to possess their property. If you take off with their property they might simply report it stolen. Wha'cha gonna do about it?
